Terms of Service
These terms govern your use of Emma AI Operator, a Clover application developed and operated by Baptiste Fort, trading as Visionia. By installing or using Emma, you confirm that you are authorized to act for the relevant merchant.
1. What Emma provides
Emma analyzes authorized Clover information, answers operational questions, prepares recommendations, and can execute specifically supported tasks after the required merchant confirmation. Available data and actions depend on Clover permissions, merchant configuration, region, plan, and technical availability.
2. Human approval and accuracy
Emma is an operational assistant, not an accountant, lawyer, tax adviser, or payment processor. AI responses and forecasts can be incomplete or wrong. You must review important decisions, source data, and every proposed change. Emma does not execute supported Clover write actions unless the interface requests and records the required approval.
3. Account and acceptable use
You must protect account access, maintain accurate merchant information, and use Emma only for lawful business purposes. You may not bypass safeguards, probe other merchants' data, upload malicious content, reverse engineer protected parts of the service, misuse customer or employee information, or use Emma to make unlawful automated decisions.
4. Clover and third-party services
Emma depends on Clover/Fiserv and other service providers. Their terms also apply to their products. We are not responsible for Clover outages, permission changes, inaccurate source records, payment processing, or a third party's suspension of access.
5. Trials, plans, and billing
Eligible new subscriptions include a seven-day free trial. The plan, price, currency, renewal period, included limits, and cancellation terms shown in Clover or at checkout control your subscription. Unless cancelled before renewal, a paid subscription renews automatically where permitted. Taxes may apply. Clover may manage billing and refunds for Marketplace purchases.
6. Data and privacy
Our Privacy Policy explains how information is processed. You retain your rights in merchant data. You grant us only the limited right needed to operate, secure, support, and improve Emma.
7. Suspension and termination
You may stop using Emma and revoke Clover access. We may suspend access to protect merchants, comply with law, address non-payment, or stop abuse. After termination, access ends and data is deleted or retained in accordance with the Privacy Policy and legal obligations.
8. Warranties and liability
Emma is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted service or a particular commercial result. To the maximum extent permitted by law, indirect or consequential losses are excluded, and total liability is limited to the amount paid for Emma during the three months before the event giving rise to the claim. Mandatory consumer and statutory rights remain unaffected.
9. Law and changes
These terms are governed by French law, without limiting mandatory protections available in your country. We may update these terms for legal, security, or product changes and will provide notice when required.
